Terms of service

The rules for using Lurk, in plain words. You own your data, you decide your rewards, and a person on your team approves what goes live.

Starter draft. This page hasn't had a lawyer's review yet and may change before Lurk launches.

1. The agreement

These terms are an agreement between you and [Company legal name] ("Lurk", "we") for using getlurk.com, the dashboard, the Lurk API, the MCP server and Lurky (together, "Lurk"). If you use Lurk for a company, you accept these terms for it and confirm you're allowed to. Our privacy policy explains how we handle personal data.

2. Your account

You need to be at least 18 to open an account. Keep your sign-in, API keys and agent keys safe: you're responsible for everything done with them. Tell us right away at [email protected] if you think someone else has access.

3. Agents and Lurky

You can let AI agents and Lurky set Lurk up for you. What an agent or key does on your account counts as done by you. Lurk asks a person on your team to approve before an agent's changes go live, so review what you approve.

Lurky and other AI features can make mistakes. Check their suggestions before you rely on them, especially rules that give out units.

4. Units, coins and rewards

Units are the points, XP, streaks and other balances you create in Lurk. You decide what they're called, how your members earn and spend them, and what rewards they unlock, and you're responsible for honoring those rewards and for any laws that apply to them (including promotion, sweepstakes, gift card, tax and consumer laws). Unless you set up something else with us in writing, units have no cash value and can't be exchanged for money through Lurk.

The coins on getlurk.com are a demo. They live in your browser, have no value and can't be redeemed.

5. Your data

You own the data you and your members put into Lurk. You give us permission to host, copy, process and show it only to provide and improve Lurk for you. You're responsible for having the right to send us your members' data, and for telling them how you use it. When you leave, you can export your data first.

6. Acceptable use

Don't use Lurk to:

  • break the law or anyone's rights, or mislead your members about rewards;
  • run gambling, or rewards that need a licence you don't have;
  • send spam, malware, or data you aren't allowed to share;
  • get around limits, probe or overload Lurk, or reach other customers' data;
  • build a copy of Lurk from it.

We may suspend accounts that do, and we'll tell you why when we can.

7. Plans and fees

Some of Lurk is free; paid plans and usage are billed as shown on our pricing page when you buy. [Billing period, renewals, refunds and taxes to be set once pricing is final.] If a payment fails, we may limit paid features until it's fixed. We'll tell you at least 30 days before a price change applies to you.

8. Changes to Lurk

Lurk is new and will change. We'll give notice before removing a feature you depend on, and we version the API so integrations don't break without warning. Features marked beta or preview may change or end at any time.

9. Our property

Lurk, Lurky, our logos and our software belong to us. You can use the API, MCP server and SDKs to build on Lurk under these terms. If you send us feedback, we may use it without owing you anything.

10. Ending the agreement

You can close your account any time. We can end or suspend it if you seriously break these terms, or with 30 days' notice for any other reason. After it ends, you'll have [30] days to export your data before we delete it.

11. No warranty

Lurk is provided "as is". To the extent the law allows, we don't promise it will be uninterrupted, error-free or fit for a particular purpose.

12. Limits on liability

To the extent the law allows, neither of us is liable for indirect or consequential losses or lost profits, and our total liability is limited to what you paid Lurk in the 12 months before the claim. Nothing here limits liability that can't be limited by law.

13. General

These terms are governed by the laws of [jurisdiction], and disputes go to the courts of [venue]. If we change these terms, we'll update the date at the top and email customers about important changes before they apply. Questions: [email protected].
